1. These terms

These are the terms you rent a container on from Altapeak Rolloffs LLC of Commerce City, Colorado. Booking a container means you accept them, whether you booked online, over the phone or by email.

They are written to be read. If something here does not match what you were told on the phone, call (303) 718-1298 and we will sort it out before the truck goes anywhere.

2. Booking and confirmation

A request through the website is a request, not a booking. Nothing is reserved until we have spoken to you and confirmed the container, the date, the placement and the price.

You are responsible for the accuracy of what you tell us, particularly the delivery address, what is going in the container and where you want it placed. A wasted trip caused by wrong information is chargeable. See section 10.

3. What the price covers

The quoted price covers delivery, collection, the tonnage included with that container and the rental period listed against it. Current prices are on the dumpster rental pricing table and on each container page. Prices are not repeated here, so there is only ever one figure to check.

Anything outside that list is extra, and every one of those is set out below: weight over the included tonnage, keeping the container past its rental period, prohibited items in the load, driveway protection, distance from our yard, and a dry run.

We confirm the full figure with you before delivery. You will not find a charge on an invoice that was not discussed first.

4. Rental periods

The rental period is not the same on every container. It lengthens with the size, because a bigger box goes on a longer job. The period starts on the day the container is delivered.

If you need the container longer, call before the period runs out. Extra days are chargeable and we will tell you the rate when you ask. Keeping a container past its period without telling us is what turns a straightforward job into a dispute.

If you finish early, call and we will collect it. There is no benefit to sitting on an empty container.

5. Weight allowances and overage

Every container includes a tonnage allowance, listed in the table above. Weight over that allowance is chargeable per ton.

The weight is whatever the scale says. Every load is weighed on a certified scale at the disposal facility and that scale ticket is what your invoice is based on. It is not an estimate, it is not the driver’s judgement and it is not a look at how full the container is. If you want to see the ticket, ask and we will send it.

Weight is the limit most people reach first without realising. Shingles, tile, plaster and anything that has been rained on are dense enough to use the full allowance while the container still looks half empty.

6. Prohibited materials

The following must not go in any Altapeak Rolloffs container. This is not a preference. Some of these are refused by the disposal facility, some are regulated by state or federal law, and some would damage the container or the truck.

• Tires. Any size, any quantity.
• Paint. Liquid or partly dried, including stains and solvents.
• Appliances containing refrigerant. Refrigerators, freezers, air conditioners and dehumidifiers. Refrigerant has to be recovered by a certified technician before the unit can be hauled.
• Hazardous waste. Solvents, pesticides, pool chemicals, asbestos, fuel and anything labeled corrosive, flammable or toxic.
• Medical waste. Sharps, pharmaceuticals and anything biohazardous.
• Electronics. Televisions, monitors, computers and small electronics.
• Concrete, brick, asphalt and dirt. These need a dedicated heavy material container and Altapeak Rolloffs does not run one. A general debris container reaches its axle rating on broken concrete long before it looks half full.
• Oil. Motor oil, cooking oil, hydraulic fluid and oil filters.

If a prohibited item is found in the load, you are charged a fee of up to per item, depending on what it is and what the facility charges to handle it. We may also refuse to haul the container until the item is removed.

If you are unsure about something, ask before you load it. That call takes a minute and it is always cheaper than the fee.

7. The level load rule

The load must sit level with the top rail of the container. Nothing may stick out above it.

This is not a company preference and it is not negotiable at the curb. A container filled above the rail cannot be tarped. An untarped load is illegal to transport on a public road, and it will be turned away at the scale. A driver who arrives to an overfilled container will not haul it.

If the pile is going to run over, the answer is a bigger container or a second one, not a heaped load. Call us and we will sort it out. If a driver has to make a return trip because a container was overfilled, that trip is chargeable.

8. Placement and access

You are responsible for making sure the container can actually be delivered and collected.

• Roughly 60 feet of straight approach at the drop spot. The truck reverses in and tilts the container off the back, so it needs a clear run rather than a tight turn.
• Overhead clearance. The container tilts up before it lands, so low branches, wires, gutters and carport roofs matter more than people expect.
• A firm surface. Soft ground, fresh asphalt and unset concrete will not carry a loaded container or the truck.
• A marked drop spot. A cone, a bucket or a chalk line. The driver places to the mark. Without one, the driver places where it looks sensible and moving it afterward is chargeable.
• Clear access on collection day. If a vehicle, a skid steer or a locked gate blocks the container, we cannot collect it.

Permits are your responsibility. A container on your own driveway or private property does not need one. A container on the street, the sidewalk or any public right-of-way does, and the process differs by city. We are happy to talk you through it, but obtaining the permit is yours to do.

9. Surface damage and driveway protection

A loaded roll off container is heavy and the truck that carries it is heavier. Driveways, sidewalks, curbs, sprinkler heads, septic lids and buried utilities can all be damaged by the weight, and that is true of any hauler, not just this one.

By asking us to place a container on your property, you accept the risk of surface damage and you release Altapeak Rolloffs from responsibility for it. That includes cracking, scuffing, gouging and marks left by the container feet or the truck wheels.

Driveway protection is available on request for an additional charge. Boards under the contact points spread the load over a wider area. It has to be asked for when you book, because the driver has to bring the materials. Asphalt is more vulnerable than concrete and both soften in summer heat, so it is worth asking on a hot week.

Tell us about anything buried or fragile before delivery day. We cannot avoid a septic lid we do not know about.

10. Cancellation and dry runs

Cancel or reschedule by calling us. There is no charge for cancelling before the truck is dispatched, and no charge for moving a date if you give us reasonable notice.

A dry run is when the truck arrives and cannot complete the job. Common causes are a blocked drop spot, a vehicle parked in the way, no access to the property, an overfilled container, or a prohibited item that has to be removed before the load can be hauled. A dry run is chargeable, because the truck, the driver and the slot were all committed to your job.

A dry run is almost always avoidable with one phone call. If something changes, tell us before the delivery day rather than on it.

11. Distance from our yard

Our yard is in Henderson. Distance from it is one of the variables in a quote, and a delivery at the far edge of our service area costs more to run than one close in.

Any distance charge is quoted before delivery and never added afterward. If it was not discussed before the container was delivered, it does not appear on your invoice.

12. Ownership of the waste

Anything placed in the container becomes the property of Altapeak Rolloffs once the container is collected, and we dispose of it as we see fit. Do not put anything in the container you might want back. We cannot retrieve items from a load once it has left your property, and we cannot retrieve them at all once the load has been tipped.

You confirm that everything in the container is yours to dispose of, or that you have the owner’s permission to dispose of it.

13. Our liability

We are responsible for delivering and collecting the container in a workmanlike manner, and we carry insurance for our operations.

We are not responsible for surface damage covered in section 9, for damage caused by information you did not give us, or for delays outside our control such as weather, road closures, a disposal facility being shut, or a vehicle breakdown. Where a delay is our fault we will reschedule at the earliest slot available and we will not charge you for the trip that did not happen.

You are responsible for the container while it is on your property, including damage to it, fire, and anything anybody else puts in it. If a neighbour fills your container with prohibited material, the fee is still yours.

14. Colorado law

These terms are governed by the law of the State of Colorado, and any dispute goes to the courts of Adams County, Colorado.

If a court decides one part of these terms cannot be enforced, the rest still stands.

15. Changes

We may update these terms. The version that applies to your rental is the one published on the day you booked, and the date at the top of this page tells you which that is.
